Title of bill
An act to amend the town law, in relation to authorizing the town board of the town of Rockland, in the county of Sullivan, to diminish the area of the Roscoe sewer district
Purpose or general idea of bill
To allow the Town of Rockland to diminish the Roscoe Sewer District by 1/2 acre.
Summary of specific provisions
The bill authorizes the Town of Rockland to diminish the Roscoe Sewer District to the extent of the metes and bounds description provided for in the legislation. The total area the district would be diminished would be 1/2 acre.
Effects of present law which this bill would alter
Section 202-c (1-a) of the Town Law (New York State Law) allows the abolition of unimproved sewer districts but does not allow the diminishment of existing districts, whether improved or not.
Justification
The sewer district was erroneously formed with the 1/2 acre parcel in it. The parcel in question is separated from the rest of the district by a creek. In order to service that property, in addition to crossing under the stream, pumping would be required in order to create adequate flow. The Town of Rockland advises such a plan is not feasible and that it was error to include the property in the District in the first place. The Town of Rockland has requested this legislation. The legislation is requested so that the property which is not being benefited by the sewer district can be taken out of it, thereby allowing the Town to stop taxing it.
