Title of bill
An act to amend the education law, in relation to the provision of certain programs and services to home-instructed pupils
Purpose
To allow home instructed pupils to participate in inter-school, intramural and extramural athletics, and other extra curricular activities with the consent of the board of education.
Summary of provisions
Section 1: Adds a new Education Law section 3204-a to provide that local school districts shall allow home instructed children to participate in extracurricular activities and school athletic programs, upon a written request, to the board of education which is filed prior to June first each year.
Existing law
Under current law, home instructed children may participate in intramural and extramural sports and extra curricular activities with the consent of the board of education, but not interscholastic sports.
Justification
Presently, home instructed pupils may participate in extra curricular activities and intramural & extramural sports at the discretion of the local board of education, but are precluded from participating in interscholastic sports by regulation. However, their families pay real property taxes to financially support such local school district. This legislation would afford parents of home instructed students the ability to bring this decision to the attention of the school board and provide home instructed pupils with the opportunity to participate in the same after-school activities that are granted to all public school pupils.
