Title of bill
An act to amend the public health law and the education law, in relation to information on the H1N1 influenza virus
Purpose
Directs the commissioners of health and education to compile and provide information on the H1N1 influenza virus through the department of health website.
Summary of provisions
Section 1. Amends section 206 of the public health law, to add a provision requiring that the commissioner of health and the commissioner of education compile and provide to the public all of the most current information on the H1N1 influenza virus both in written format and on the Health Department internet website.
Section 2. Amends section 305 of the education law to include a new subdivision requiring that the commissioner of education consult and cooperate with the commissioner of health to compile and provide current and relevant information regarding the H1N1 influenza virus to the public in both written format and through the Department of Health's website. The Department of Education's website is also required to include a link to the Health Department's website regarding the virus.
Existing law
None.
Justification
As of January 2010, more than 209 countries and overseas territories reported laboratory confirmed cases of pandemic influenza H1N1 2009. This included at least 14,711 deaths worldwide. To date, the total number of deaths in New York (absent New York City) since April 2009 has been 88 persons. As such, New Yorkers seeking information about the H1N1 influenza virus should have access to reliable and current information via one authoritative gateway.
This bill ensures easy access to such information by requiring the Commissioners of the Department of Health and Education to compile the information and provide it in one location a "one-stop-shop" on the website of the Department of Health. To that end, this bill will set the standard for prospective guidelines when our State faces unique and emerging medical crises that face our population (e.g. MRSA).

Effective date
