Title of bill

An act to amend the tax law, in relation to providing a sales and compensating use tax exemption on Energy Star appliances

Purpose

To exempt most Energy Star rated products from State sales tax during four one-week exemption periods. Localities will have the option to exempt these Energy Star rated products during the exemption periods. Also, permanently exempt from State and local sales tax are alternative energy systems and insulation products and materials including windows, doors, skylights and roofing materials.

Summary of provisions

Section one of the bill amends subdivision (a) of section 1115 of the tax law by exempting alternative energy systems and Energy Star rated insulation products and materials from State and local sales tax.

Section two of the bill instructs the New York State Energy Research and Development Authority to develop programs and materials to encourage the sale of Energy Star products.

Sections three and four of the bill amends the tax law by exempting most Energy Star appliances from State sales tax during the first week of each sales tax quarter.

Statement in support

Due to higher energy costs, the State along with the New York State Energy Research and Development Authority should play an active role in urging consumers to purchase Energy Star rated products and alternative energy systems.
