Title of bill
An act to amend the executive law, in relation to cooperation between police agencies and the United States bureau of immigration and customs enforcement
Purpose
To encourage cooperation and foster a better and more efficient working relationship between state and local police agencies and the BICE with regard to persons arrested under state law and who are reasonably suspected of being in the U.S. in violation of federal immigration laws, as provided for in the Personal Responsibility and Work Opportunity Reconciliation Act, passed by Congress in 1996 and signed into law by the President.
Summary of provisions
This legislation would require state and local police agencies to cooperate with the BICE. Specifically, it would require such agencies to verify the citizenship status of persons arrested under state law and who are reasonably suspected of being illegal aliens and to notify the attorney general as well as the BICE of such persons' suspected status, and would provide for cooperation between the attorney general and the BICE. It would also prohibit local governments in the state from seeking to prevent or limit such cooperation.

Justification
Because immigration is primarily a federal responsibility while at the same time most law enforcement occurs at the state and local level, it is vital that state and local police agencies cooperate with the BICE when such agencies come in contact with persons reasonably suspected of being in the U.S. in violation of federal immigration laws.
Fiscal implications
None.
Effective date
The thirtieth day after it shall have become a law.
