Title of bill

An act allowing Michael Petry, employed by the city of New Rochelle, to enroll in a twenty year retirement plan

Summary of specific provisions

Section 1 allows Michael Petry, a firefighter in the city of New Rochelle and member of the New York State and Local Police and Fire Retirement system, to apply for participation in the twenty year retirement plan by filing the appropriate application with the state comptroller on or before June 30, 2011. This section allows the city of New Rochelle to elect to allow such participation by filing with the state comptroller before December 31, 2010 a resolution of its governing body certifying that said firefighter is eligible to apply as of that date.

Section 2 provides that the cost of his election to the twenty year retirement plan shall be borne by the City of New Rochelle.

Section 3 provides the effective date.

A fiscal note is provided.

Justification

Michael Petry was eligible to enroll in the twenty year retirement plan, pursuant to Section 384-d of the Retirement and Social Security Law. For reasons other than his own negligence, Mr. Petry failed to apply in a timely manner for participation in the plan. This bill would allow Mr. Petry to apply for enrollment in the twenty year retirement plan, which he would have done had he been given the opportunity at the appropriate time.

This is a local bill that has been requested by the City of New Rochelle.

Fiscal impact

Local Fiscal Impact: Estimated increase of approximately $3,800 in the annual contributions of the City of New Rochelle for the fiscal year ending March 31, 2011. There will be no immediate past service cost since this will match the release of liabilities which occurred when Mr. Petry chose to rescind his Section 384-d coverage.

Fiscal impact to state

None.

Effective date

This act shall take effect immediately.
