Title of bill
An act to amend the education law, in relation to requiring the superintendent of each school district to provide notice of the days the district will be closed to the nonpublic schools to which the district provides transportation
Purpose
To provide parity in how school districts across the state provide transportation services to non-public pupils and to increase the number of days that school districts may be required to provide transportation to students who attend non-public schools.
Summary of provisions
Section 1: Amends Education Law section 3635(2-a) to provide parity in the maximum number of days that all New York State school districts are legally required to provide transportation to students attending non-public school, not to exceed 10 days.
Existing law
The current law does not provide parity between school districts in this state as to the requirements for transporting non-public school students.
Justification
Under current law, the New York City School District must provide transportation to non-public school students on those days on which the public schools are closed, up to a maximum of five days. The 5 days are restricted to: Wednesday, Thursday, and Friday after Labor Day, Rosh Hashanah, Yom Kippur, the week in which public schools are closed for spring recess; or the week between Christmas and New Year's Day. In every year in which Easter Sunday is separated from either the first or last day of Passover by more than 7 calendar days, the number of days that public and non-public schools remain open differ by more than 5 days. This legislation authorizes all school districts to provide transportation to non-public school students for more than 5 days, but less than 10 days provided that such school district shall not be required to provide more than 180 days of transportation services.
