An act to amend the vehicle and traffic law, in relation to mandatory suspension of driver's licenses for conviction of insurance fraud related to the ownership or use of a motor vehicle

Purpose

Provides that a person convicted of insurance fraud shall have his or her driver's license suspended for one year and registration may be suspended.

Summary of provisions

Section 1: Paragraph b of subdivision 2 of section 510 of the vehicle and traffic law is amended by adding a new subparagraph (xiv) to read as follows: for a period one year where the holder is convicted of, or receives a youthful offender or juvenile delinquency adjudication in connection with a violation of section 176.10, 176.15, 176.20, 176.25. 176.30, 176.35 of the penal law.

Justification

Insurance fraud is a serious problem in New York State and the punishment should accurately reflect the severity of these crimes. Many unscrupulous people utilize their motor vehicle to stage automobile accidents in order to file fraudulent insurance claims. This bill, should it become law, will add another layer to a very serious and costly crime.
