Title of bill

An act to amend the public authorities law, in relation to the science and technology law center; and to repeal section 209-q of the executive law, relating to the science and technology law center

Purpose or general idea of bill

To recodify the science and technology law center from the executive law to the public authorities law and to establish the technology commercialization clinic.

Summary of specific provisions

The legislation would establish the technology commercialization clinic administered by the New York state foundation for science, technology and innovation (NYSTAR) and managed by the science and technology law center for the purposes of assisting universities, entrepreneurs and companies in the state in commercializing new products and processes. Entities eligible to operate the clinics would be competitively selected and would include business, law and engineering schools and other academic research entities located at colleges and universities in the state. Students supervised by appropriate faculty and university administrators would conduct such activities as engaging in research and analysis of the commercial development of early-stage technologies and providing research and analysis of technical, marketing, intellectual property and legal issues related to commercial development of new technologies.

Effects of present law which this bill would alter

Repeals section 209-q of executive law and adds new sections 3102-f and 3102-g to public authorities law.

Justification

New York State invests over $100 million a year in university research and New York State universities invest nearly $4 billion a year in research through government, industry and internal funding. The State ranks second nationally in total research spending by universities. However, New York State universities incubate fewer new companies (35) than Massachusetts (60) and California (56), and has far fewer fast-growing new companies (11) than California (169) and Massachusetts (46). The great challenge is to transform extraordinary research investment into commercially viable products and processes and create new jobs. A major problem in commercialization of research is the lack of business and legal information and analysis necessary to guide the development of early-stage technologies and to plan the launch of start-up companies, This program would directly address this problem.
