BILL NUMBER:S7022B
Title of bill
An act to amend the penal law, in relation to the crime of assault on the operator of a for-hire vehicle
Purpose or general idea of bill
To protect taxi drivers from being assaulted on the job by increasing criminal penalties for such assaults and posting warnings in taxi cabs about such penalties.
Summary of specific provisions
Section 1 titles the bill the "taxi driver protection act."
Section 2 amends subdivision 1 and paragraph (a) of subdivision 2 of section 60.07 of the penal law, and adds a new subdivision 3, to (1) add assault in the second and third degrees as specified offenses subject to the related sentencing enhancement in this section, (2) limiting the sentence for misdemeanor offenses under this chapter to twice the maximum definite sentence otherwise authorized, and (3) require each for-hire vehicle to post a sign inside their vehicle warning that "assaulting a taxi driver is punishable by up to twenty-five years in prison," although livery and black car drivers will have the right, but not the obligation, to post such a sign.
Section 3 amends section 10.00 of the penal law to add the phrase "except as may otherwise be provided by law" to the definition of "misdemeanor.
Section 4 provides for the act to take effect immediately.
Justification
According to the federal Occupational Safety and Health Administration, taxi workers are thirty times more likely to be killed on the job than other workers. New York City is home to the largest taxi driver industry in the country.
Increasing penalties for attacks on taxi drivers underscores the gravity of the crime and, together with the requirement that a warning be posted about the serious criminal penalties for assaulting a taxi driver, will help to deter such crimes from occurring in the future.
