BILL NUMBER:S7080B REVISED 06/08/10

Title of bill

An act to amend the retirement and social security law, in relation to the retirement rights of professional firefighters association members

Purpose

To ensure all current and future professional firefighters association members are enrolled in the tier II retirement system.

Summary of provisions

Adds section 419 to the retirement and social security laws, affecting the rights of professional firefighters association members as follows. All current and future members of the professional firefighters association, IAFF local 282, hired prior to the expiration of successor collective bargaining agreements and/or interest arbitration awards, shall be enrolled in tier II pursuant to article eleven of this chapter. Only employees hired after a new collective bargaining agreement and/or interest arbitration award shall be enrolled in a tier other than tier II.

Justification

In 2009 the legislature passed a new tier V pension bill for public employees and starting January 2010 this statute shall take effect. The intention of the pension bill is to place any firefighters hired after January 2010 into the tier V plan. The professional firefighters association members have operated honorable without a new collective bargaining agreement for a substantial period of time. Their original contract places members under the tier II retirement system and under Taylor Law it remains the standard until a new agreement is reached.

To resolve this issue section 419 is added to the retirement and social security law specifying the protection of tier II statute for current and future members of the professional firefighters association. Additionally, this legislation allows for members, after a new collectively bargaining agreement is reached to be registered within a retirement tier other than tier II.
