Title of bill
An act to amend the election law, in relation to audit of voter verifiable records
Purpose
This bill corrects a technical error in Election Law Section 16-113 by clarifying that any candidate or his or her agent must bring a special proceeding to obtain a court order directing a manual audit of the voter verifiable paper record of the votes applicable to the candidate.
Summary of provisions
Section 1: Amends Election Law section 16-113 to add that "a special proceeding" must be commenced in court to obtain an order for a manual audit of the votes cast for the office for which a candidate is running.
Section 2: Provides for the Act to take effect immediately.
Existing law
Under current law, Section 16-113 does not define what type of legal proceeding a candidate or his or her agent must commence to obtain a court order for a manual audit of the vote.
Justification
This amendment is a technical correction needed to define how a candidate or his or her agent may request and obtain a court order for a manual audit.
