Title of bill

An act to amend the election law, in relation to maintenance requirements for the board of elections in the city of New York

Purpose

The bill requires the board of elections in the city of New York to maintain a voting machine storage and preparation facility in each borough of the city.

Summary of provisions

Section 1: Amends Election Law section 3-214(1) to require that the board of elections in New York City not only maintain a headquarters office in the borough of Manhattan, and an office in each borough of the city, but also that it maintain a voting machine storage and preparation facility in each borough.

Section 2: Provides for the Act to take effect immediately.

Existing law

Under current law, Section 3-214(1) requires the board to maintain an office in each of the five boroughs, and it makes no mention of storage and preparation facilities for the new optical scan voting systems and ballot marking devices that have been or are being acquired.

Justification

The bill clearly and explicitly directs the Board of Elections in the city of New York City establish and maintain both an office and a voting machine storage and preparation facility in each borough of the city.

Nearly one-third of the voting machines in New York City are required to be delivered to private sites that require delivery on the day before Election Day and require pick up on the day after it. In order to adequately administer elections, voting machines should be stored in the borough where they are to be used and may need repair or replacement on or around Election Day. Currently, there are storage facilities for voting machines in each of the boroughs, and they are being retrofitted to accommodate the needs of the new voting systems as necessary. This bill requires that the existing system of having voting machine storage and preparation facilities in each of the boroughs be maintained in order of to minimize logistical problems related to their transportation, maintenance and repair.
