Title of bill

An act to amend the transportation law, in relation to the membership of the Stewart airport commission

Purpose

This bill would designate the Ulster County Executive as an ex officio member of the Stewart Airport Commission.

Summary of provisions

Section 1 of this bill would amend Transportation Law § 401(1) to replace the Chairperson of the Ulster County Legislature with the Ulster County Executive in the list of ex officio members of the Stewart Airport Commission.

Section 2 of this bill provides for an immediate effective date.

Existing law

Transportation Law § 401 (1) establishes the Stewart Airport Commission and lists the members. The Orange County Executive and Dutchess County Executive are ex officio members. However, the statute designates the Chairperson of the Ulster County Legislature as the ex officio member of the Commission from Ulster County.

Justification

At the time the Stewart Airport Commission was established Ulster County did not have an elected County Executive. As a result, although the County Executives of Orange and Dutchess Counties were designated in Transportation Law § 401 as ex officio members of the commission, the Chairperson of the Ulster County Legislature was designated as the Ulster County representative.

In 2006 Ulster County voters approved a new charter that created an elected County Executive position. In 2008 the first individual to fill this position was elected. This bill would update Transportation Law § 401 (1) to reflect this change in Ulster County government, and to ensure that all three Counties (Orange, Dutchess and Ulster) are represented in the same manner on the Commission.
