Title of bill
An act to amend chapter 59 of the laws of 2009 amending the environmental conservation law relating to establishing a recreational marine fishing license and setting the fees for such license, in relation to the effectiveness thereof
Purpose
To change the effective date of the provisions of Chapter 59 of the Laws of 2009 relating to the establishment of a recreational marine fishing license and fee requirements from October 1, 2009 to July 1, 2010
Summary of provisions
Section 8 of part LL of Chapter 59 of the Laws of 2009 amending the environmental conservation law relating to establishing a recreation marine fishing license and setting the fees for such license is amended to change the effective date from October 1, 2009 to July 1, 2010
Justification
Provisions that were adopted in the final 2009-10 State Budget established a recreational marine fishing license in the State of New York beginning October 1, 2009 and imposed fees varying from $10 annually for residents and $15 annually for non-residents. Party and charter boats will be required to pay $400 for this annual license.
The legality of these new provisions of law has been challenged by various towns located within the Long Island marine district. Ongoing court litigation has resulted in a temporary delay in issuance of recreational marine fishing licenses in some of these affected areas. This legislation is necessary to extend the effective date of these provisions to July 1, 2010 to insure that all legal concerns associated with the implementation of these newly enacted provisions are properly addressed.
