Title of bill

An act to repeal section 7 of a chapter of the laws of 2010 as proposed in legislative bills numbers S. 5523-A and A. 10130 amending the education law and the general municipal law relating to enacting the education mandate relief act of 2010, relating to the education mandate relief act of 2010

Purpose

To repeal technical aspects of the Education Mandate Relief Act of 2010.

Summary of provisions

Section 1 repeals section 7 of a chapter of the laws of 2010 amending the education law and general municipal law relating to enacting the education mandate relief act of 2010, as proposed in legislative bills numbers S.5523-A and A.10130.

Justification

Mandate relief, a cornerstone of property tax relief, has never been more vital for the taxpayers of New York State. The Education Mandate Relief Act was designed to provide the most comprehensive relief from mandates to our schools in decades. Unfortunately, one unintended consequence that has the potential to lead to property tax increases was contained in Section 7. In order to maintain the intent of the bill to guarantee property tax relief, Section 7 must be repealed.
