BILL NUMBER:S7287B

Title of bill

An act to amend chapter 313 of the laws of 2004 relating to creating the D.R. Evarts library district in a portion of the town of Athens, in relation to filling vacancies on the board of trustees and in relation to budget proposals; and to amend chapter 672 of the laws of 1993, amending the public authorities law relating to the construction and financing of facilities for certain public libraries, in relation to including D.R. Evarts library district within the provisions of such chapter

Purpose

The purpose of the legislation is to amend provisions relating to the election of the board of trustees of the D.R. Evarts library district in Greene County.

Summary of provisions

Section 1 provides that for elections to fill vacancies on the library board of trustees occurring in between annual elections, the polls shall be open from 12 PM to 9 PM. Further, this section reduces the number of signatures required on a petition to nominate a candidate for a vacancy on the board of trustees from fifty to twenty-five. This section also clarifies that absentee ballots would be allowed in annual elections.

Section 2 provides that, when a vacancy occurs on the board between annual elections, the position may be filled by appointment until the next annual election.

Section 3 requires the finance committee of the board of trustees to review and audit the disbursement of all funds of the library district.

Section 4 adds the D.R. Evarts library to the list of public libraries eligible for construction and financing projects under the public authorities law.

Justification

This legislation came at the request of the D.R. Evarts library board of trustees. Chapter 313 of the laws of 2004 created the D.R. Evarts library district in the town of Athens and set forth various provisions relative to the operation of the library. As a small, rural library district, satisfying many of these requirements have proven to be quite onerous, particularly those relating to elections for members of the library board of trustees. This legislation reduces many of these burdens, including lowering the number of required signatures on nomi- nating petitions from 50 to 25 and allowing for the use of absentee ballots. Further, the legislation clarifies that the board may make appointments to fill vacancies between annual elections without the need for nominating petitions.
