Title of bill

An act to amend the tax law, in relation to exempting certain food sales to senior citizens from sales tax

Purpose

To exempt persons 65 years of age or older from a sales tax on food or drink sold to them in reduced portions and at a reduced cost.

Summary of provisions

Paragraph (ii) of subdivision (d) of section 1105 of the tax law is amended by adding a new subparagraph (C) to provide any person 65 years of age or older with a sales tax exemption if they purchase food or drink in a reduced portion and at reduced prices at any restaurant, cafeteria or the like.

Justification

Senior citizens often live on fixed incomes and already face immense financial difficulties given today's high cost of living. The proposed amendment would ameliorate this situation by lessening the extra tax burden placed on seniors.

Legislative history

2003-04 (S.4483/A.6396)

Fiscal implications

Sales tax revenues would negligibly decrease.

Effective date

One hundred eighty days after enactment.
