Title of bill

An act to amend the real property tax law, in relation to establishing county real property tax service agencies as being independently constituted agencies

Purpose

To make the real property tax service agency an independently constituted agency.

Summary of provisions

Subdivision 1 of §I states that the real property tax service agency shall be an independently constituted agency or department.

Subdivision 2 of 51 states that the position of director of real property tax services shall be classified in the noncompetitive class of the civil service.

Justification

The intention of §1530 clearly indicates that the real property tax service agency shall have various specific duties and that that agency shall be headed by a director appointed by the appropriate county authority (i.e., legislature, county executive or manager depending upon the particular charter). The job of director is one of a policy maker and, therefore, should be in the noncompetitive class. The law currently provides that each district shall have a six-year term subject to reappointment. The state currently has no director in the competitive class.
