Title of bill
An act to amend the general business law, in relation to enacting the landscape irrigation contractor certification act
Purpose
To require landscape irrigation contractors to be certified.
Summary of provisions
Adds a new article 33-C to the general business law requiring landscape irrigation contractors to be certified.
Initial certification shall require examination, application and fee of $100. Renewal of certificate shall require continuing education and fee of $125. Course of instruction shall include areas not otherwise restricted to licensees pursuant to Title 8 of the Education Law.
Violators shall be liable for a civil penalty of not more than $500 for the first offense, $1000 for the second or subsequent offense, and may be subject to injunction prohibiting the act or practice in violation of this article.
Justification
The proper installation of irrigation systems is essential to protect the consumer, community and environment. Experience in other states has indicated that an irrigation system installed by a certified contractor uses considerably less water, thereby using water more efficiently. How irrigation systems drain can also be an issue for the community and environment due to possibility of various pollutants in water runoff.
By requiring irrigation contractors to be certified, which requires among other things, the passage of an examination, consumers can be assured that their irrigation system has been installed by a properly trained professional.

Effective date
This act shall take effect immediately except that subdivision 1 of section 698-b of the general business law, as added by section two of this act, shall take effect 18 months after this act shall have become a law.
