Title of bill

An act to amend the public health law and the social services law, in relation to rates of payment for continuous nursing services for medically fragile persons

Purpose

To establish that funding for nursing care of medically fragile children will be available for all medically fragile adults.

Summary of provisions

Section 1 -- Amends subdivision 3-a of section 3614 of the Public Health Law. Changes "medically fragile children" to "medically fragile persons," and alters payment to nurses who continuously care for medically fragile persons.

Section 2 -- Amends subdivisions 1-a and 2 of section 367-r of the Social Services Law. Establishes that funds available for nursing care for medically fragile children will be available for all medially fragile persons.

Section 3 -- Effective date.

Justification

Currently, rates for nursing services to medically fragile children are higher than rates for care for other individuals in a similar medical situation. This can cause financial issues when the child reaches an age that causes him or her to no longer be eligible for this funding. This legislation seeks to correct this problem by ensuring that all medically fragile persons are eligible for this increased level of funding.

Legislative history
