Title of bill
An act to authorize the village of Upper Brookville to expend trust funds to provide access to a park
Purpose
The bill authorizes the Village of Upper Brookville to expend certain funds from the recreation site and improvement fund for the repair of Donna Drive to provide access to a passive park.
Summary of provisions
Authorizes the Village of Upper Brookville to expend certain funds from the recreation, site and improvement fund for the repair of Donna Drive.
The expenditure will only be made following a majority vote of the Board of Trustees of the Village of Upper Brookville and will not exceed $200,000.
Justification
The Village of Upper Brookville seeks to utilize funds from the recreation, site and improvement fund for the repair and extensive rebuilding of Donna Drive. The road is in a state of disrepair and needs to be refurbished so that it can be used to safely access and egress from a proposed passive nature park project. The establishment of the passive park is contingent upon getting permission to use park funds from the recreation, site and improvement fund.
Section 7-730 of the New York State Village Law requires legislative approval to expend funds not used exclusively for recreational uses. This legislation will authorize the use of up to $200,000 for the rebuilding of Donna Drive, a road which provides access to the proposed passive park project.
