BILL NUMBER:S7811A
Title of bill
An act to amend the real property law, in relation to prohibiting the implementation of electronic billing and/or payment of rent without the tenant's consent
Purpose
This bill would prevent a landlord from mandating that tenants can only pay rent through an electronic billing and/or payment system.
Summary of provisions
The bill adds section 235-g of the real property law, stating:
1. A landlord shall not require a lessee or tenant to use an electronic billing and/or payment system as the only method for the payment of rent. A landlord shall not assess any fee or other charge for a lessee or tenant that chooses not to use an electronic billing and/or payment system.
2. Any agreement by a lessee or tenant of a dwelling waiving or modifying his or her rights as set forth in this section shall be void as contrary to public policy.
Justification
Mandatory use of electronic or Internet billing for rent payments is an unjust and unacceptable demand to be placed on the elderly, indigent and others who may be intimidated and unable to utilize these systems. This legislation would preserve the option of using an electronic rent payment system should a - tenant consent to using one, while eliminating the usage of them as a means to - inconvenience and harass elderly and other tenants into vacating dwelling units.
