Title of bill

An act to amend the public service law, in relation to requiring the New York state independent system operator to increase end-use consumer representation

Purpose

This bill would require certain operating changes to be made by the New York state independent system operator and require consideration to be given to end-use consumers.

Summary of provisions

Section 1. Sets forth Legislative findings in relation to the NYISO.

Section 2. Requires the NYISO to ensure that the interests of end-use consumers be considered when administering tariff provisions. It further requires that the ISO agreement and section 9.02 of the management committee by-laws be amended to add the deputy secretary of energy to the governor as a member of the NYISO board selection subcommittee.

Section 3. Requires that the NYISO provide an annual report to the legislature and to the public service commission on the impact of New York's wholesale power markets on end-use consumers.

Justification

Much confusion and concern exists with respect to the operations and functions of the New York State Independent System Operator, Inc (NYISO). The NYISO manages the flow of power over 11,000 circuit miles of high voltage transmission lines from more than 300 generating units. It is also responsible for the administration of open and competitive wholesale electricity markets. This bill seeks to ensure that the NYISO always consider the direct impact of any and all of its actions on end-use consumers.
