Title of bill

An act to amend chapter 704 of the laws of 1991, amending the arts and cultural affairs law and chapter 912 of the laws of 1920 relating to the regulation of boxing and wrestling relating to tickets to places of entertainment, in relation to extending the expiration of the provisions thereof

Purpose

This bill would extend the scheduled sunset of Article 25 of the Arts and Cultural Affairs Law, from May 15, 2010 to May 21, 2010.

Summary of provisions

Section 1 of the bill would extend the scheduled sunset of Article 25 of the Arts and Cultural Affairs Law, from May 15, 2010 to May 21, 2010.

Section 2 of the bill would notwithstand the General Construction Law to ensure the continuity of the statute.

Section 3 of the bill would make the bill effective immediately.

Existing law

The regulatory framework governing the sale and resale of tickets to places of entertainment is contained in Article 25 of the Arts and Cultural Affairs Law.

Statement in support

This legislation is being submitted to delay the scheduled sunset of Article 25 of the Arts and Cultural Affairs Law, and the consequent reversion to a governance framework contained in the presently dormant Article 25 of the Arts and Cultural Affairs Law as promulgated generally by the Laws of 1920.

The purpose of this one-week extender is to avoid unnecessary disruption in the ticket sale and resale marketplace, as well as the enforcement burdens that will result from a sunset. During this time, it is anticipated by the Executive that the Executive and Legislature will negotiate a longer term extension of the statute.

Budget implications

This legislation would not have any impact on the State's Financial Plan.
