BILL NUMBER:S7902 REVISED 06/04/10
Title of bill
An act to amend the public health law, in relation to requiring that certain New York citizens who have been discharged from the armed forces or the national guard be provided with a copy of their certificates without charge
Purpose
To allow those who serve in the armed forces and National Guard the ability to receive a free copy or his or her birth certificate.
Summary of provisions
Section One of the bill amends section 4174 of the public health law to create a new subsection (b) to state that no fee shall be charged to any citizen of New York state who has been discharged from the armed forces or the National Guard with an honorable discharge or with a general discharge with honorable conditions. Discharges based on "homosexual conduct" shall be considered a general discharge for purposes of this section.
Existing law
Does not allow members of the armed forces or National Guard the ability to receive free birth certificates.
Justification
Persons being discharged from the armed forces or National Guard face many barriers to a successful re-entry to the community. One significant barrier is the inability to obtain proper identification (i.e. driver's license, social security card). Securing proper identification is vital to a veteran's ability to find stable employment, housing and secure benefits. Providing each veteran with a birth certificate upon release will allow veterans to more easily obtain the necessary identification.
