Title of bill

An act to amend the vehicle and traffic law, in relation to exempting a motor vehicle with an automatic or remote car starter from certain prohibitions

Purpose of the bill

This legislation clarifies that it is legal for a person to start their motor vehicle with an automatic or remote car starter without being in violation of subdivision (a) of section 1210 of the vehicle and traffic law.

Summary of provisions

Section 1. Subdivision (a) of section 1210 of the vehicle and traffic law, as amended by chapter 350 of laws 1967, is amended to clarify that this subdivision shall not apply to any motor vehicle with an automatic or remote car starter.

Section 2. Effective Date.

Justification

According to Subdivision (a) of section 1210 of the vehicle and traffic law, no person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition, and removing the key from the vehicle. Last amended in 1967, this section is outdated and has not been properly aligned to account for modem technological innovations that allow a person to start his/her motor vehicle by the use of a remote from a separate location. Therefore, this legislation clarifies that this subdivision shall not apply to any motor vehicle with an automatic or remote car starter where such a motor vehicle is able to remain running with or without keys in the ignition and all the doors to the motor vehicle are locked.

Prior legislative history

2005-2006: S.7330 - Transportation; 2008 - Passed Senate

Fiscal implications

None.

Effective date

This act shall take effect on the hundred eightieth day after it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.
