BILL NUMBER:S7996

Title of bill

An act relating to monies received by the Highland Falls-Fort Montgomery central school district

Purpose

Relates to the levy of real property taxes

Summary of provisions

Section 1: For the purposes of state aid, the Highland Falls-Fort Montgomery Central School District, which receives federal monies pursuant to Title VIII of the Elementary and Secondary Education Act of 1965, shall utilize and include such monies when computing the residential real property tax levy pursuant to subparagraph 1 of paragraph a of subdivision 16 of section 3602 of the education law.

Section 2: Enacting clause.

Justification

This legislation has been requested by the Highland Falls Fort Montgomery School District. This district receives federal monies pursuant to Title VIII of the Elementary and Secondary Education Act of 1965 (ESEA) because 93% of their land is nontaxable due to federal and state ownership. The ESEA funds are received from the federal government to replace the lost tax revenue on the federal portion and, through this legislation, will be considered as the equivalent of local tax revenue in the computation of school aid.
