BILL NUMBER:S8017
Title of bill
An act to amend the education law, in relation to charter schools
Purpose
The purpose of this bill is to provide for a technical clarification regarding the approval and issuance process for charters.
Summary of provisions
Section 1 would amend subdivision 9-a of section 2852 as added by a chapter of the laws of 2010 amending the education law relating to char- ter schools, as proposed in legislative bill number A.11310 to clarify that the schedule laid out for the maximum number of charters that can be issued between 2010 and 2013 does not prevent any remaining charters under the cap of 460 from being issued in years subsequent to 2013. Charters issued subsequent to 2013 will be issued according to an RFP process but with no limitations on how many charters may be issued in a given year until the cap is reached.
Justification
This bill would provide clarification that charters not issued by Decem- ber 31, 2013 are still eligible to be issued based on subsequent requests for proposals published by the Board of Regents or the Board of Trustees of the State University of New York.
It is the intent of the sponsors that any charters provided for in this bill remaining to be issued after 2013 shall be permitted to be issued until the cap is reached.
Legislative history
This is a new bill.
Fiscal implications
None.
Effective date
This act shall take effect on the same date and in the same manner as a chapter of the laws of 2010, amending the education law relating to charter schools, as proposed in legislative bills numbers S.7990 and A.11310, takes effect.
