BILL NUMBER:S8104
Title of bill
An act to amend the public health law, in relation to notification of rate increases to residents of assisted living residences
Purpose of bill
Require assisted living residences (ALRs) to give residents prior notice of rate increases and a description and methodology for how the rate increase was determined and makes provisions for required information and disclosures in residency agreements.
Summary of specific provisions
The bill amends the public health law by adding a new section 4664.
Subdivision 1 requires facilities seeking a rate increase to provide no less than 45 days prior notice to the residents or residents' representatives, setting forth the amount of the increase and the reason for the increase.
Subdivision 2 requires facilities seeking a rate increase of more than 10 percent to provide no less than 90 days prior written notice to the residents or the residents' representatives, setting forth the amount of the increase and the reason for the increase.
Subdivision 3 prohibits facilities from charging nonrecurring lump-sum assessment but shall be rate amortized over a twelve month period. The prohibition against a lump-sum assessment does not apply to charges for specific goods or services provided to an individual resident.
Subdivision 4 requires facilities to include pertinent information in residency agreements, including a description of any items and services; a comprehensive description of billing and payment policies; and a statement indicating that rates may be increased, the conditions under which rates may be increased.
Justification
Many ALRs have been increasing rates on a frequent and erratic basis. Unanticipated increases, while legal, make it difficult for residents and their families to budget and plan for living expenses. In order to improve the financial stability of residents of ALRs, this bill requires greater upfront disclosure of potential rate increases and costs that residents may face. Currently, the New York State Department of Health regulates assisted living residences, and requires ALRs seeking a rate increase to provide residents no less
than 45 days prior written notice. This legislation would make these provisions statutory.
