BILL NUMBER:S8106
Title of bill
An act to amend the executive law, in relation to notice requirements and enforcement for residential buildings with truss type construction
Purpose or general idea of bill
To add § 382-b of the executive law requiring any applicant applying to erect a new structure or rehabilitating an existing structure to provide the municipality with a notarized affidavit affirming that the applicant has notified, by certified mail, any fire department that holds jurisdiction that truss type construction is being utilized.
Summary of specific provisions
Section 1 amends the executive law by adding a new § 382-b, that will obligate an applicant to provide the municipality with a notarized affidavit affirming that the applicant has notified, by certified mail, any fire department that holds jurisdiction that truss type construction is being utilized.
Section 2 sets the effective date.
Justification
In recent years truss constructions have been the cause of the preventable deaths of many firefighters. In the likelihood of a fire, firefighters are unable to differentiate between a building constructed of truss foundation or another type of construction. When weakened by a fire major components of a truss foundation collapse suddenly without warning, resulting in deaths and injuries. As a result of the danger, it is imperative that firefighters are notified of the utilization of such construction in an effort to take appropriate preparation measures and to ensure their safety. With the implementation of this bill, emergency control operators will be better prepared and will take the proper precautions.
