BILL NUMBER:S8114
Title of bill
An act authorizing the assessor of the county of Westchester, town of Ossining, to accept an application for exemption from real property taxes from the House of Refuge Apostolic Church for a certain parcel of land located in such town
Purpose or general idea of bill
The Assessor of Ossining is authorized to accept an application for a retroactive tax exemption from the house of Refuge Apostolic Church for a parcel of land in the Town of Ossining.
Summary of specific provisions
Section 1. The Assessor of Ossining is authorized to accept from the House of Refuge Apostolic Church, an application for exemption from real property taxes pursuant to section 420-a of the real property tax law for the 2007 assessment for the parcel located at 81 Croton A venue in the Town of Ossining, (section 89.015, block 3, lot 34).
If accepted, the application shall be reviewed as it had been received on or before the taxable status date established for such roll.
If satisfied that the House of Refuge Apostolic Church acquired title to the property within appropriate deadlines, and would have been entitled to such exemption, if filed by the appropriate taxable status date, the Assessor of Ossining, upon approval by the Ossining Town Board, may grant exemption from taxation beginning with the date of acquisition of the property by the House of Refuge Apostolic Church and make appropriate correction of this subject roll.
If the exemption is granted, and the House of Refuge Apostolic Church paid any taxes, the governing body or tax department may, at its discretion, provide for a refund, and cancel taxes, fines, penalties, or interest remaining unpaid.
Justification
There were several tax exemptions and planning board issues regarding the intended use of the space by the House of Refuge Apostolic Church delaying the issuance of a certificate of occupancy, in turn delaying the application for exemption. All of these issues have since been resolved and the Town of Ossining requests that the enabling legislation be passed to provide for this exemption.
