BILL NUMBER:S8116

Title of bill

An act to amend the environmental conservation law, in relation to the transfer of a lifetime license for hunting, fishing and trapping

Purpose

The purpose of this legislation is to allow the transfer of a lifetime license upon the death of the purchaser within the first year of purchase, or when an active member of the United States Armed Forces dies in combat.

Summary of provisions

Section one amends the prohibition on the transfer of sporting licenses to allow transfer under the conditions set in section two.

Section two allows a lifetime sporting license to be transferred if all of the following conditions are met:

-The purchaser dies within a year of purchase

-The recipient is a legal resident of the State

-The recipient would otherwise be eligible to purchase the license or permit

-The recipient is related to the purchaser by first degree of consanguinity, legal marriage, or is the adopted child or step child or step sibling of the purchaser

-The personal representative of the decedent's estate designates the recipient

-The applies for the transfer is made within three years of the issue date of the license -The recipient pays the fee

This section allows lifetime licenses belonging to veterans who die in war to be transferred outside of the set time limits.

Section three sets the fee for the transfer at $50.00. This section also makes technical changes in subsection lettering.

Justification

Lifetime sporting licenses are a privilege many recreational enthusiasts enjoy for their simplicity, permanence, and value. Purchasing a lifetime license signifies a lifelong commitment to conservation and the outdoors.

This legislation would allow a lifetime license to be transferred in cases where the purchaser dies within the first year. However, this bill recognizes that death by a veteran serving in war is an unforeseen circumstance, and a courageous sacrifice. The bill allows the license to be transferred outside of the time limits set in these circumstances.

Legislative history

This is a new bill.
