BILL NUMBER:S8153
Title of bill
An act to amend the election law, in relation to the form of paper ballots and party emblems
Purpose or general idea of bill
This bill amends and updates several sections of Article 7 of the election law to define election day paper ballots that will be used when utilizing ballot scanners.
Summary of specific provisions
Section 1 of the bill amends section 7-106 of the election law to define "election day paper ballots" that will be used with ballot scanners and codifies the instructions that will appear on the ballot.
Section 2 of the bill amends section 7-122(1) of the election law to conform, where possible, the instructions on absentee ballots that will be counted by hand.
Section 3 of the bill amends section 7-104 of the election law to remove the party emblem in the voting square to allow additional space for the candidate's name. It also clarifies that the party emblem will appear at the head of the column or the beginning of the row depending on the orientation of the ballot next to the extended hand.
Section 4 of the bill amends section 7-122 (2), (3), (4), (5), (8), (9) and (10) of the election law to conform, where possible, the instructions absentee ballots that will be counted by a central scanner and to clarify how all absentee ballots shall be mailed to the voter. This section also repeals all the provisions related to punch card ballots.
Section 5 of the bill is the effective date.
Justification
The State of New York is scheduled to begin to use polling place ballot scanners beginning with the Primary Election in September 2010 in compliance with the federal Help America Vote Act and enabling state legislation. This bill defines the "election day paper ballots' that will be used with the new ballot scanners and conforms the form of absentee ballots to the new Election Day paper ballots where possible. The bill continues the format for ballots that has been in place in New York for many years except where the features of the new machines warrant a change in language or substance. Most notably, the party emblem will no longer appear in the voting square to allow additional space for a candidate's name. The party emblem will continue to appear at the head of the column or the beginning of the row depending on the orientation of the ballot.
