BILL NUMBER:S8158A

Title of bill

An act to amend the education law and the retirement and social security law, in relation to permitting a waiver of earnings limitations for certain retirees of the New York state and local police and fire retirement system employed by the city university of New York

Purpose or general idea of bill

Permits retirees of the New York state and local police and fire retirement system and the New York City Police Pension Fund to re-enter public service for the city university of New York.

Summary of specific provisions

Section 1 of this legislation removes the earning limits on members of the NYS policemen's and firemen's retirement system and the New York City Police Pension Fund who retire and are employed by the city university of New York.

Justification

Unlike New York's public employee retirees, private sector and non New York public retirees are not restricted in the amount of earning they can receive if they choose to return to New York public employment after retirement. New York public service retirees must be granted a waiver pursuant to Section 211 of the Retirement sand Social Security Law in order to earn over $30,000 per year or be subject to a reduction in their retirement benefits. Currently, there are numerous New York retirees who are valuable law enforcement personnel who are essential members of the faculty in the areas of criminal justice and law enforcement, or who are essential members of the public safety operations on college campuses.

Enactment of this legislation will dramatically broaden the pool of eligible candidates for the teaching faculty, the position of University Security Director and the position of College Security Director. This will contribute greatly to education in and security of the campuses of the city university of New York.

Prior legislative history

Fiscal implications

Fiscal note 2010-177 prepared by the Actuary for the New York State and Local Police and Fire Retirement System states that if this bill is enacted, insofar as it will affect the New York State and Local Police and Fire Retirement System, we expect few retirees to be affected. There would be negligible additional annual costs.
