BILL NUMBER:S8159
Title of bill
An act to authorize the assessor of the town of Brookhaven, in the county of Suffolk, to accept an application for exemption from real property taxes from the Temple Baptist Church for a certain parcel of land located in the town Brookhaven
Purpose
The bill allows for the Town of Brookhaven to accept an application of property tax exemption on a parcel of land owned by the Temple Baptist Church. If accepted, the application shall be reviewed as if it had been received on or before the taxable status date (March 1, 2009) established for such roll.
Summary of provisions
Section 1 allows the Town of Brookhaven to accept the application for real property tax exemption for the Temple Baptist Church, even after the deadline has past. Furthermore, it leaves the assessor of the Town of Brookhaven to have the authority to refund the taxes that have been paid as if the application and approval was filed before the deadline.
Section 2 gives the effective date of the bill.
Justification
The Temple Baptist Church property was a different church with different owners prior to October 2009. Because of the change of ownership, the property had lost its real property tax exemption status. Furthermore, the deadline for filing for real property tax exemption was March 1, 2009. This bill would allow for the Temple Baptist Church to file for the real property tax exemption retroactively as if it owned the property prior to March 1, 2009. Generally, religious institutions are not-for-profit institutions exempt from paying real property taxes, but the new owners were unable to file for that exemption. This will allow the Temple Baptist Church to apply for that status and will be exempt from paying taxes dating back to October 2009 when the land changed ownership.
