BILL NUMBER:S8177A

Title of bill

An act to amend the alcoholic beverage control law, in relation to the manner of posting and changing beer prices to whole- salers and retail licensees

Purpose

This legislation limits the price charged for beer to retail beer licensees in relation to the price charged non-contracted beer wholesalers.

Summary of provisions

Adds section 53-b of the alcoholic beverage control law requiring brewers and franchised wholesalers to maintain a price differential from wholesalers to retailers.

Justification

New York must maintain its four-tier beer distribution system (brewers, wholesalers, non contracted wholesalers, retailers). Wholesalers are using their exclusive agreements to unfairly undermine the non-contracted wholesalers positioning the market. This bill would allow non-contracted wholesalers to compete fairly with the large contracted wholesaler and foster lower prices to consumers.

Fiscal implications

None to the State.

Effective date

This act shall take effect on the sixtieth day after it shall become law.
