BILL NUMBER:S8179

Title of bill

An act to amend the not-for-profit corporation law, in relation to an exemption to the residency requirement for firefighters of the Huguenot Fire Co., Inc.

Purpose

To include the Huguenot Fire Co., Inc. in Orange County among the list of fire districts and fire companies which are exempt from the statutory limits on the percentage of non-resident members, thereby helping enable this volunteer fire company to have a sufficient level of membership to protect the community.

Summary of provisions

Section 1. Amends Subparagraph 3 of paragraph (c) of section 1402 of the not-for-profit corporation law, as amended by chapter 351 of the laws of 2000 to exempt the Huguenot Fire Company, Inc. located in the town of Deerpark in Orange County from the requirement that the percentage of non-resident members of a fire department cannot exceed 45% of the total membership of the department.

Section 2. Effective Date

Existing law

Section 1402 of the not-for-profit corporation law generally provides that the percentage of non-resident members of a fire department cannot exceed 45% of the total membership of the department. However, a significant number of Fire Companies and Districts have been exempted from this requirement in recent years.

Justification

This legislation is critically important for the Huguenot Fire Co., Inc.'s ability to recruit and retain volunteer members.
