BILL NUMBER:S8205

Title of bill

CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing amendments to section 3 of article 7 of the constitution, in relation to implementing the budget submitted by the governor when the budget is not enacted by the legislature in a timely manner

Purpose

The bill would provide that the proposed Executive Budget be adopted on April 1st if an agreed upon budget has not been approved by both legis- lative houses and the Governor until such time as the legislature and Governor adopt an agreed upon budget for that fiscal year.

Summary of provisions

Section 1 Describes the purpose of the bill. Section 2 Sets forth the process by which the bill would be approved since it amends. Section 3, article 7 of the constitution.

Justification

Although attempts have been made to improve the process by which a State budget is adopted by the April 1st deadline, these efforts have not proven effective since they have required action by legislative leaders. In 2007 the Budget Reform Act was adopted that required that Joint Conference Committees be held to resolve differences between the proposals supported by both legislative Houses as well as provide more transparency to the public. Those committee meetings were held in 2008 and a budget was passed in a timely fashion. However, during both the 2009 and 2010 the new Senate Democrat Majority refused to hold those Committees and, again, a budget was delayed. This bill would enact the Governor's proposed budget so that finally, late budgets would be elimi- nated since leaders would no longer have the capability of violating budget reform laws.

Legislative history

New bill.

Fiscal implications

Undetermined savings to the State.

Effective date

The foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly and, in conformity with section 1 of article 19 of the constitution, be published for three months previous to the time of such election.
