BILL NUMBER:S8221A
Title of bill
An act authorizing the lease of lands located at the State University of New York at Albany
Purpose or general idea of bill
This legislation would permit the construction of needed office and laboratory space that is required to support the University's legislatively mandated mission of research.
Summary of specific provisions
Authorizes the State University of New York Trustees the power to lease and otherwise contract to make available 11.07 acres to Fuller Road Management Corporation (FRMC) grounds and facilities of the campus of the University at Albany for the purpose of constructing additional facilities to fulfill its legislatively mandated mission of research.
Authorizes the development, construction and operation of a basic research, technology outreach business development and office building, including additional office and laboratory space.
Such lease shall be a period not exceeding 40 years without any fee simple conveyance and otherwise upon terms and conditions determined by the Trustees, and subject to the approval of the director of the division of the budget, the attorney general and the state comptroller.
Requires that all work performed on such property ordinarily performed by employees subject to Article 14 of the Civil Service Law continue to be performed by such employees.
Authorizes FRMC to lease, sublease, construct, reconstruct, rehabilitate, improve, operate and manage the grounds and facilities and to obtain funding or financing for the purposes of completing the project.
Requires that any contracts entered into by FRMC and parties contracting with FRMC be awarded by a competitive process.
Provides that upon the expiration or termination of the lease, or in the event that the property that is the subject of such lease is no longer used for the purposes set forth in the legislation, the property and any improvements will revert to the State University of New York.
Justification
This legislation would permit the construction of needed office and laboratory space that is required to support the University's legislatively mandated mission of research. Specifically, the additional office and laboratory space will support the University's College of Nanoscale Science and Engineering, the New York State Center for Excellence in Nanoelectronics and associated semiconductor research activities funded by active
partnerships between government and private industry. Furthermore, such activity will promote economic development across the capital region of New York State.
The legislature finds that granting the Trustees of the State University of New York the authority and power to lease and otherwise contract to make available grounds and facilities of the campus of the University at Albany will promote the effective use of such lands for the public good.
