BILL NUMBER:S8271
Title of bill
An act to amend the social services law, in relation to the assumption by the commissioner of health of the responsibility for reimbursement of transportation costs under the medical assistance program
Purpose
Removes commissioner of health's authority to assume responsibility for transportation costs.
Summary of provisions
Section one establishes that the local social services official shall be responsible for the provision and reimbursement of transportation costs under this section.
Section two establishes the effective date.
Existing law
Current law provides that the commissioner of health may assume responsibility from a local social services official and then may contract with a transportation manager to oversee such duties.
Justification
The current law allows the commissioner of health to not only take responsibility of duties which it has not managed in the past, but also allows such responsibility to include the ability to contract with a transportation manager by circumventing the state's competitive bidding and contract reporting laws. Many of these transportation managers have not properly fulfilled duties on past contracts with other entities, including states and state agencies, which could lead to an erosion of important services to Medicaid recipient and customers in New York.
Legislative history
FISCAL IMPLICATIONS: None.
Effective date
This act shall take effect immediately.
