BILL NUMBER:S8292

Title of bill

An act to amend the executive law, in relation to the duties of the attorney general

Purpose of general idea of the bill

To provide express authority to the Attorney General to enforce certain sections of law of the Vehicle & Traffic law.

Summary of provisions

Section one of the bill provides the Attorney General the specific authority to enforce article 17-A of the Vehicle & Traffic law.

Justification

Article 17-A has been recently amended and updated in view of changing circumstances within the automobile industry and to more clearly establish the criteria for the reimbursement of dealers when providing warranty services. However, the provisions in the article meant to level the playing field between franchised automobile dealers and franchisors and provide for fair dealings have been continuously avoided, ignored or further misapplied. This bill would expressly allow for enforcement of the provisions by the Attorney General, authority which currently can be generally inferred from current law. Providing the Attorney General with the express authority for enforcing the provisions of Article 17-A would provide dealers with the authority to have their legitimate claims reviewed without placing the dealer in an adversarial position with their manufacturer.
