BILL NUMBER:S8307
Title of bill
An act authorizing the city of New Rochelle to sell and convey certain lands in the city of New Rochelle
Purpose
To allow the City of New Rochelle to convey a parcel of land for the purpose of facilitating economic development within the city.
Summary of provisions
To allow the City of New Rochelle to sell, alienate and and convey the parcel identified in Section 3 to further the economic development of the waterfront.
Section 2: Provides the specific section, block and lot numbers of the referenced parcel.
Section 3: Provides a metes and bounds description of the parcel.
Section 4: Authorizes the Commissioner of General Services to take action as may be necessary to release, extinguish and relinquish forever any state limits and rights to revertor and/or reversion for the property.
Section 5: Establishes that the act shall take effect immediately.
Justification
HOME RULE REQUEST - The City of New Rochelle has requested that legislative authority be granted to the city regarding the aforementioned parcel in order to advance plans to develop the waterfront, a proposed mixed use project of residential, retail and recreational uses. The parcel in question was conveyed by the state to the city over a decade ago with restrictions attached or implied. As a matter of home rule, city officials request the full authority to convey the property as may be needed to complete the waterfront project. Any ultimate action taken by the city on this site would be subject to existing laws mandating proper public notice, public hearing, SEQR procedures and other public protections to ensure community involvement prior to any final decision.
