BILL NUMBER:S8333
Title of bill
An act to amend the general business law, in relation to auction requirements
Purpose or general idea of bill
To add an exemption of auctions conducted by or on behalf of government entities from the provisions of the recently passed auction requirements established in Section twenty-nine of the General Business Law.
Summary of specific provisions
Section one of this Chapter amendment would lower the population thresh- old of counties affected by this statute from 200,000 to 45,000 people.
Section two states that the new paragraph f of subdivision eight of section twenty-nine would exempt auction or auctions of certain highway equipment conducted by or on behalf of the federal government, or the state, its agencies, bureaus, boards, commissions and authorities, or any political subdivision of the state, or the agencies and authorities of any such subdivision from the "Requirements for Auctions" section of the General Business Law. Section twenty-three of the General Business Law, Automobile Auctioneers, has a similar automobile exemption for auctions by governmental entities.
Section three of the bill would provide for the effective date.
Justification
It has become clear during the legislative process that S.4113D/ A.1730D went through that many more counties in the State of New York would benefit enormously from the provisions provided in this chapter.
In addition, the auctioning of motor vehicles has a long established system regulated under section twenty-three of the general business law that provides for the exclusion of auctions conducted by the state, its agencies, political subdivisions, and other entities. This bill recog- nizes that governmental auctions are different from those performed in the art market and provides for language similar to the automobile auctioneer statute that will exempt those auctions from the provisions of requirements for auctions as established in a chapter of the laws of 2010, as proposed in legislative bill numbers S.4313D and A.1730D.
Prior legislative history
New bill.
Fiscal implications
None.
Effective date
This bill would take effect on the same date as a chapter of the laws of 2010, in relation to auction requirements.
