Title of bill

An act to amend the environmental conservation law, in relation to granting the director of a municipality the power to enforce the redemption of beverage containers at redemption centers

Purpose or general idea of bill

Grants the director of a municipality the power to enforce the redemption of beverage containers at redemption centers.

Summary of specific provisions

Section 1 amends section 27-1013 of the environmental conservation law, as amended by chapter 149 of the laws of 1983.

Justification

The returning of bottles and cans for the nickel deposit has become a thriving industry. When individuals collect numerous bottles and cans that have been discarded their attempts to return these recyclable items have caused individuals returning smaller amounts to be inconvenienced. Redemption centers have taken the matter into their own hands, illegally limiting the number of returns allowed in one day. The Department of Environmental Conservation currently holds the only enforcement power over redemption centers, but is limited in their resources and ability to watch all of the local redemption centers. By expanding these authorities to municipalities, they will have enhanced ability to enforce these provisions quicker and more efficiently as they are geographically closer to the problem.
