BILL NUMBER:S8444
Title of bill
An act to amend the education law, in relation to persons required to be notified of bedbug infestations in certain public schools
Purpose or general idea of bill
To require New York City school health services to provide notification to the entire school community upon discovery of bed bugs.
Summary of specific provisions
Chapter amends S.4472 and A.5434 to provide for notice of a bedbug infestation in a public school to the guardians of affected students in the school.
Subdivision 1 of section 920 of the education law, as added by a chapter of the laws of 2010, amending the education law relating to directing a city school district having a population of one million or more to provide notice of bedbug infestations in public schools, as proposed in legislative bills numbers S.4472 and A.5434.
The notification would enable parents/guardians to make more informed decisions as to the health and safety of their child and family.
Includes "guardian of potentially affected students attending the school" as persons to be notified in addition to parents or persons in parental relation. Also adds that the principal shall advise the parents' association or parent-teachers association of the scope of such notification.
Justification
Currently, if a bed bug is discovered in a school, only the family of the affected child is notified. Additional notifications are left up to the discretion of school health officials.
New Yorkers have grown increasingly concerned over the alarming rate of bed bug incidents in their community. Since bed bugs are notoriously difficult to exterminate and result in a serious emotional and financial impact, New Yorkers need to receive as much information as possible, as soon as possible.
Support
The NYC Department of Education withdrew its opposition to S.4472 and A.5434 with this chapter amendment.
Prior legislative history
A.5434 substituted for S.4472 passed Senate on June 25, 2010.
Fiscal implications
None.
Effective date
This act shall take effect on the same date and in the same manner as a chapter of the laws of 2010, amending the education law relating to directing a city school district having a population of one million or more to provide notice of bedbug infestations in public
schools, as proposed in legislative bills numbers S.4472 and A.5434, takes effect.
