BILL NUMBER:S8448
Title of bill
An act to authorize the town justice of the town of Deerfield to temporarily reside outside of such town until such justice's term expires on December 31, 2011
Purpose or general idea of bill
Allows Town Justice Walter Loin to temporarily reside outside the town of Deerfield.
Summary of provisions
A special act, notwithstanding Section 3 of the Public Officer's Law, or any law, rule or regulation, to allow Town Justice Walter Loin to temporarily reside outside the town of Deerfield until such time that his term expires on December 31, 2011.
Justification
The Town of Deerfield has requested that the New York State Legislature introduce and pass legislation that would allow Town Justice Walter Loin to temporarily live outside the Town of Deerfield until his term expires on December 31, 2011. Due to a personal situ- ation, Justice Loin will temporarily reside in the Town of New Hartford, which is 7 to eight miles from the Town of Deerfield. Consequently, Town Justice Loin will no longer be eligible to serve as town justice because the Public Officers Law requires that any individual serving in a town office must be an elector of the town. It is requested by the Town of Deerfield that Justice Loin be allowed to complete his term as town justice.
