BILL NUMBER:S8479
Title of bill
An act to amend chapter 100 of the laws of 2010 relating to making appropriations for the support of government, in relation to expendi- tures and disbursements and to repeal chapter 313 of the laws of 2010 amending the state finance law relating to establishing the FMAP contin- gency fund and amending chapter 100 of the laws of 2010 relating to making appropriations for the support of government
Purpose
The bill seeks to repeal the FMAP Contingency Plan that was enacted as part of the State Fiscal Year (SFY) 2010-11 budget.
Summary of provisions and statement in support
Governor Paterson included in his Executive Budget proposal for SFY 2010-11 approximately $1.1 billion in financial assistance arising from continuation of increased reimbursement for New York State from the federal government for the State's share of the Medicaid program.
During budget negotiations, receipt of this assistance seemed less like- ly so the Governor and Legislature agreed to create the FMAP Contingency Plan. The Plan seeks to reduce local assistance disbursements by $281 million to offset any difference between the amount of FMAP included in the SFY 2010-11 budget and the amount the federal government will actu- ally provide.
Since enactment of the SFY 2010-11 budget, the federal government has taken a number of actions to provide additional financial assistance to New York State. In addition, the State has taken additional actions that result in greater receipts or lower disbursements. These actions, along with the complexity arising from implementation of the FMAP Contingency Plan, suggest the mechanism created to reduce local assistance payments is not needed and/or equitable to those that will be negatively impacted. As such, this bill seeks to repeal the Plan.
Budget implications
Actions taken by the State since adoption of the budget that result in increased receipts and reduced disbursements suggest that repeal of the FMAP Contingency Plan can be accomplished without negatively affecting the SFY 2010-11 budget.
