BILL NUMBER:S8500

Title of bill

An act to amend the public authorities law, in relation to the creation of the Suffolk health care corporation and providing for rights, powers, duties and jurisdiction

Purpose or general idea

The purpose of this bill is to establish a public benefit corporation in Suffolk County, the John J. Foley Nursing Facility, which will deliver high quality, affordable, integrated health care.

Summary of provisions

This bill adds a new title to the public authorities law. The title relates to the establishment and operation of the John J. Foley Nursing Facility.

The provisions pertain to: the transfer of county health care facilities and other assets to the corporation; the transfer of officers and employees; the general and special powers of the corporation; bond issues; actions against the corporation; the transfer to the corporation county applications to the state, and approvals and permits issued to the county by the state; and the applicability of laws to the corpo- rations.

The corporation will have the ability to negotiate fees, purchase its own equipment and supplies, and enter into agreements with other health care providers. The bill, however, is not intended to provide authority for the corporation to accept financial risk for the provision of services, including, but not limited to, capitation payments, except to the extent that the corporation is entitled to receive such payments pursuant to law.

Justification

The health care landscape in New York is rapidly changing. As the new era of health care develops, it is important that the residents of Suffolk continue to have access to high-quality, cost-effective health care. A similar public benefit corporation to which this legislation creates for Suffolk County is utilized in Nassau County, under which the A. Holly Patterson Facility has been successfully operated since 1998.

Current legal and operating constraints imposed on the county prevent county health care facilities and services from effectively competing with other non-public providers. The establishment of a public benefit corporation in Suffolk, a public corporation which will not be shackled with unduly burdensome operating constraints, to own and operate certain of Suffolk's health care facilities and services, will allow those facilities and services to more effectively deliver high-quality inte- grated health care, and have a greater ability to compete with other providers in the market. This bill provides Suffolk with the necessary

legal, financial and managerial tools to deliver high-quality, afforda- ble integrated health care in Suffolk County.
