BILL NUMBER:S8505

Title of bill

An act to amend the general business law, in relation to prohibiting the sale of caffeinated malt beverages

Purpose

To prohibit the sale of caffeinated malt beverages.

Summary of provision

Section one amends the General Business Law by adding a new section 399-ddd prohibiting the importation, distribution or sale of caffeinated malt beverages. Whenever the court determines that a violation has occurred, the court may impose a civil penalty up to $1000.00 for each violation.

Justification

Recently, there has been increased prevalence of malt beverages that include caffeine. According to health advocates, these sugary, caffeinated energy drinks with high-alcohol content can suspend the effects of alcohol consumption allowing a person to consume more drinks than usual. In addition to high levels of caffeine these products also contain high levels of alcohol. When caffeine, an energy booster that makes people feel more alert, is combined with alcohol, a depressant, a person may be less aware of the adverse effects of the alcohol which could lead to dangerous behavior. In addition, these products are made with fruit flavors such as watermelon, fruit punch and blue raspberry. They are packaged with colorful labeling making it likely to promote underage drinking.
